I've Been Robbed
Let me start by saying that I have a pretty broad interpretation of "fair use" when it comes to photos on the internet. Where it applies to dogs:

At first I thought "Wow! I'm breeding pups similar to Dr. Smiths." I've met Dr. Smith and hold him in very high regard. But then I looked at the photo again. Here I blew it up for you:

It's not too clear, so I saved the original photo for you:

That's not a pup LIKE mine, that's MY PUPPY. Since it's one of two puppies on the site, I believe the implication is that you can get a pup like this from von Seiger Boss kennel, but you can't. Dr. Smith doesn't own or use genetics anything like what I breed. If you want a pup like the one above, I'm breeding his sister this spring.
I didn't get a thank you, or a link to my site (so maybe Google would place me higher), nothing.

This is Marshfield's Alignak "Drake." The photo was taken in Hanover, Massachusetts by ME when he was eight or nine weeks of age.

If Dr. Smith offers an apology, I'll accept it. But this is a pretty serious trespass in my opinion. I suppose I should be flattered, as imitation is the greatest compliment. However I am not being imitated, just ripped off. Imitation would be getting his pup to sit in such a pose and snapping a photograph.
- If I took the picture, I have the right to use it, so long as it's clear if it isn't my dog or progeny, I will tell you who is responsible for the animal. If I don't know (for instance group pictures at a clinic) at least I have to make it clear that it isn't mine.
- If I own a dog, I think I have a right to use photos of it taken by any amateur, previous owners, etc.
- If I produce a pup, I feel like it's OK to use photos sent to me (with thanks to the owner and amateur photographer), if posted on a web-site, with thanks and a clear link to that site.
- If I breed to a stud, I think I have the right to use amateur photos of him, again with thanks and links and credit where due.
- I feel I have the right to use photos of ancestors of the pups I produce, so long as I explain what relationship my pups have to the dog in the photo, and provide links back to the owners (usually other breeders).
- I also feel I have the right to use screen shots of other websites if they contain pictures of my dogs.

What can i say... i can only offer my sympathy, and let you know that there is a low life coming out of the wood work everyday with the way the world is going....so in the note, we who believe in you, and know that you are an honest man will stand behind you!!!.... and "I" as an old fashion and honest man want to stand behind us few and proud and let you know that i have taken it upon myself to send him i really nasty email, just to let him know what the honest people in the world think of him........ Stand Tall and Proud Todd....we are behind you !!!!

Thanks for the support Mr. Doe. What's heartbreaking to me is Shawn Smith is anything but a lowlife. He's a super nice guy and a good breeder. He's one of the good guys. I'm still waiting for an explanation, but I'm hoping he had a professional web designer or something who put up the picture and he OK'd it thinking it was just some stock photo.
Please don't e-mail bomb him.

Does the peson in question know that you are accusing him of stealing the picture?

I have asked him via email why he is using it. I will follow up via telephone if I don't get a satisfactory response. As I've stated before I hold Dr. Shawn Smith in the highest regard and hope this is all just a misunderstanding.
